R: Depende de dónde vives. Si vives en uno de los 38 estados que no tienen ninguna ley de crímenes de odio o que no incluyen la orientación sexual o la identidad de género en sus leyes de crímenes de odio, puede marcar una gran diferencia. La Ley Matthew Shepard y James Byrd, Jr. de prevención de crímenes de odio autoriza al Departamento de Justicia a investigar y procesar la violencia motivada por cualquier prejuicio basado en la orientación sexual, identidad de género, género o discapacidad, reales o percibidos, de la víctima. Estas categorías expandidas se añaden a la lista de crímenes de odio por raza, color, religión u origen nacional que ya se incluían en la ley federal de crímenes de odio existente. La ley proporciona ayuda federal a las agencias estatales y locales encargadas del orden público cuando investigan violencia motivada por odio. Q: What does the new federal hate crimes law mean for me? What if I am the target of a hate crime or bringing charges against someone?

A: It depends on where you live. If you live in one of the 38 states that either have no hate crime laws at all or that don’t include sexual orientation or gender identity in their hate crime laws, it could make a big difference. The Matthew Shepard and James Byrd, Jr. Hate Crimes Prevention Act authorizes the Department of Justice to investigate and prosecute bias-motivated violence that is based on the victim’s actual or perceived sexual orientation, gender identity, gender or disability. These expanded categories join the list of hate crimes based on race, color, religion or national origin which were included in an existing federal hate crime law.

The law provides federal help to state and local law enforcement agencies as they investigate hate-motivated violence, which may take the form of grants or technical, forensic or prosecutorial assistance. The new hate crimes law allows you to report an incident to local or state law enforcement knowing that additional assistance may be available to facilitate the investigation or prosecution. In addition, you can also directly contact the FBI regarding investigation and prosecution of such crimes.

With this new law, more people who face bias-driven crime may have additional support in seeking redress. We hope this law will send a message that violence motivated by hate will not be tolerated in this country and it is a welcome first step towards other critical federal protections for the lesbian, gay, bisexual and transgender community. Though it comes too late to provide justice for the victims of violence we have already lost, it holds the promise of greater safety and respect for LGBT people today and in the future.
