Q: I recently came to the United States from Iraq. I am afraid of returning when my visa expires because of how gay men are being hunted and killed there by fundamentalists. Is there a way I can legally remain in the United States without being deported once my visa expires?
A: The United States permits people to qualify for asylum if they demonstrate that they face danger in their home country based on certain personal traits. Asylum may be granted if an individual can show that he or she qualifies as a refugee based on past persecution or a well-founded fear of future persecution because of, among other personal characteristics, membership in a particular social group. Lesbian, gay, bisexual and transgender (LGBT) people can qualify as belonging to a particular social group for purposes of seeking asylum. An asylum applicant must demonstrate that the persecution was or would be perpetrated or authorized by government authorities, or that the government is unwilling or unable to control those responsible for it. Current reports from Iraq are extremely distressing and may indicate that the Iraqi government either is indeed either unwilling or unable to control those who persecute gay men. You should immediately contact an attorney because there are stringent limits on how much time one has after entering the United States to file a petition for asylum.
