La respuesta es No! No hay amnistía, pero hay asuntos relacionados en desarrollo:
El mes pasado, el Presidente Obama anunció una estrategia para maximizar la eficiencia de los recursos del gobierno federal al revizar y dar prioridad a más de 300,000 casos que actualmente están en proceso de remoción. Casi de manera inmediata, los notarios por todo el país comenzaron a planear cómo atraer a inmigrantes solicitando dinero por beneficios de inmigración que todavía ni siquiera existen. Esta serie de estafas causó que la Asociación de Abogados Americanos de Inmigración dieran a conocer la siguiente alerta:
“No le creas a cualquiera que te diga que pueden enlistarte para tener un permiso de trabajo (o EAD) o hacer que tengas un status legal con base en el anuncio del 18 de agosto, 2011 de la Secretaria Napolitano! Si alguien dice eso no debes creerle!
NO hay un modo seguro de que te entregues a inmigración y NO hay garantía de que tu caso será considerado de baja prioridad. CUALQUIER persona que entre en contacto con las autoridades de inmigración puede ser arrestado, detenido, o deportado.
Solamente un ABOGADO DE INMIGRACIÓN CALIFICADO puede evaluar tu caso y decirte cuales son tus derechos.
NO BUSQUES ayuda legal de un notario o consultante de inmigración.

La Administración de Obama dejó muy claro que no hay amnistía. No hay forma de aplicar para un EAD o permiso de trabajo. De hecho, el anuncio aplica SOLAMENTE a casos que ya están en el sistema.
No hay aun reglas sobre cómo se manejarán los casos para determinar si son de baja prioridad. Los casos serán revizados individualmente para determinarlo. Hasta que el gobierno federal diga como planean implementar esta nueva poliza, nada ha cambiado.
He tenido muchas preguntas sobre si las parejas del mismo sexo que son bi-nacionales deberían casarse y aplicar para beneficios de inmigración. Mi respuesta ha sido que depende. Si estás en algún tipo de procedimiento de inmigración, entonces quizás someter una aplicación de inmigración podría ayudar…sin embargo, si no estás en el sistema del gobierno, la respuesta es un rotundo NO!

Is there an Amnesty?
The answer is No! There is no amnesty, but there are potential developments:

Almost immediately, the notaries all over the country started planning on how to lure unsuspecting immigrants into giving them money for immigration benefits that do not yet exist. The extent of this hype caused the American Immigration Lawyers Association to issue the following warning:
“Do NOT believe anyone who tells you they can sign you up for a work permit (or EAD) or get you legal status based on the Secretary Napolitano’s August 18, 2011 announcement! Anyone who says that is not to be trusted!
There is NO safe way to turn yourself in to immigration and there is NO guarantee that your case will be considered low priority. ANY person who comes into contact with immigration authorities may be arrested, detained, or even removed.
Only a QUALIFIED IMMIGRATION LAWYER can evaluate your case and tell you about your rights.
DO NOT seek legal advice from a notario or immigration consultant.

The Obama Administration made very clear that there is no amnesty. There is not a way to apply for an EAD or work permit. In fact the announcement applies ONLY to cases already in the system.
There are no rules in place yet as to how cases will be regarded as low priority. Cases will be reviewed individually for a determination. Until and unless the federal government issues guidance on how they plan to implement this new policy, nothing has really changed.
I’ve gotten a lot of inquiries on whether same sex bi-national couples should get married and apply for immigration benefits. My answer has been that it depends. If you are in some type of immigration proceedings, then perhaps making an immigrant application might help … however, if you are not on the government’s radar, the answer is a resounding NO!
