Basicamente, del modo en que supuestamente debe trabajar el programa es que cuando la justicia se tope con personas que han cometido crímenes serios, se envíe una alerta a ICE y una vez que las cortes criminales terminen sus trámites con la persona, en lugar de liberarlo lo entreguen a ICE para determinar si en base a la ofensa por la que han sido convictos se les puede poner en proceso de deportación.

Sin embargo, no es asi como el programa ha sido implementado. La red que abarca Comunidades Seguras es muy amplia; personas indocumentadas y aun residentes permanentes con infracciones menores pueden quedar atrapados en ella. La propia base de datos del gobierno federal indica que más del 50% de los deportados bajo este programa son inmigrantes con poca actividad criminal o sin historial criminal.

Oficiales del enforzamiento de las leyes en los condados de San Francisco y Santa Clara ya han indicado que el programa tiene efectos negativos en los inmigrantes afectando la disponibilidad de estos para reportar crímenes. Las fuerzas policiales de todo el país reportan preocupaciones de que en sus esfuerzos diarios por parar la actividad criminal, ahora tienen que convencer a las comunidades inmigrantes de que no están interesados en deportarlos – lo cual es la orden que han recibido.

Legisladores en CA, IL, MA y NY han mostrado resistencia al programa. Quieren salirse del mismo – se suponía que el programa sería voluntario. Sin embargo, se ignoraron las preocupaciones manifestadas por algunos Estados cuando la Administración de Obama tomó una sorpresiva desición terminando con el acuerdo “MOA” que había con algunos Estados y esencialmente el programa se volvió nacional.

No se equivoquen – Comunidades Seguras destruye relaciones entre comunidades inmigrantes y el enforzamiento de la ley local y lo que es peor, hace que esas comunidades sean muy inseguras! Aun más, tontamente agota los preciados recursos en estos tiempos económicos difíciles deportando a personas que no son criminales! Mientras tanto, las víctimas de crímenes no se sentirán seguras reportando crímenes porque no quieren ver a las personas que aman terminar siendo deportados.

La policía local ha trabajado sin descanso en años recientes para ganarse la confianza de las comunidades de inmigrantes y que reporten conductas criminales. Ahora, los lazos entre esas comunidades y la policía no son muy fuertes.
Por favor déjale saber al Presidente Obama que Comunidades Seguras es un programa que no funciona y que debería desmantelarse.

Secure Communities

Secure Communities is an Immigration and Customs Enforcement (ICE) program which is suppose to target serious convicted felons and national security threats and facilitate their deportation. Upon its inception in 2008, ICE signed a Memorandum of Agreement (MOA) with 42 states to implement the program.

Basically, the way the program is suppose to work is when serious criminals come across the criminal justice system, ICE is alerted and once the criminal courts are done with the convicted individual, instead of being released they are handed over to ICE to determine if the person is removable for the offense(s) they’ve been convicted for and if so, they are placed in removal proceedings and later deported.

However that’s not how the program has been implemented. The net casted by Secure Communities is too wide; undocumented or even legal permanent residents with minor infractions may get caught in it. The federal government’s own data indicate that more than 50% of the deportees under this program are immigrants with little or no criminal activity.

Already, law enforcement officials in San Francisco and Santa Clara Counties have indicated that the program has a chilling effect on immigrant’s willingness to report crimes. Police forces from all over the country report concerns that in their daily efforts in stopping criminal activity, they now have to convince the immigrant communities that they are not interested in getting them deported – which is a tall order.

Legislators in CA, IL, MA and NY have resisted the program. They want to opt out – since the program was suppose to be voluntary. However, state’s concerns were ignored last month when the Obama Administration made a surprising decision by terminating the MOA’s it had with individual states and essentially went national with the program.

Make no mistake – Secure Communities destroys relationships between immigrant communities and local law enforcement and thus makes those very communities insecure! Furthermore, it foolishly exhausts precious resources in these hard economic times in deporting non-criminals! Meanwhile, victims of crimes will not feel safe reporting crimes because they don’t want to either personally or see their loved ones end up in removal proceedings.

Local police have worked tirelessly in recent years to earn the trust of immigrant communities in reporting criminal behavior. Now the bonds between those communities and the police are in jeopardy.

Please let President Obama know that Secure Communities is a failed program and should be dismantled.

Efectivo de manera inmediata, las huellas de las personas arrestadas en el Condado de Los Angeles serán analizadas de manera simultanea por el FBI para ver si tienen historial criminal y por el Departamento de Seguridad Nacional para ver si residen de manera ilegal en el país.

La iniciativa del Immigration and Customs Enforcement permite al ICE determinar si alguien recién arrestado es un inmigrante criminal peligroso para proceder con la deportación, de acuerdo con la agencia.

Anteriormente, como parte del proceso de registro, se tomaban las huellas y se buscaba si había información criminal en el sistema biométrico del Departamento de Justicia que mantiene el FBI.

Con la implementación de la iniciativa llamada Comunidades Seguras en el Condado de Los Angeles, la información de las huellas será ahora checada de manera simultanea tanto para ver si hay información sobre la persona en los records criminales del FBI como en los records de inmigración con base-biométrica que mantiene el DHS.

DHS to Cross-Check Fingerprints of ALL Those Arrested in LA County

Usually, I make a collage of various immigration-related news items for this column. This month, I am devoting the whole column to a very important wire service report put out at the end of August 2009. It is reprinted below:

Effective immediately, fingerprints of people arrested in Los Angeles County will be simultaneously checked against both FBI criminal history records and immigration files maintained by the Department of Homeland Security.

The initiative by Immigration and Customs Enforcement enables ICE to determine whether a newly arrested person is a dangerous criminal immigrant so deportation proceedings can begin, according to the agency.

Previously as part of the booking process, fingerprints were taken and checked for criminal history information against the Justice Department’s biometric system maintained by the FBI.

With the implementation of the so-called Secure Communities initiative in Los Angeles County, fingerprint information will now be simultaneously checked against both the FBI criminal history records and the biometrics-based immigration records maintained by the DHS.

“Our goal with this effort is to use information sharing to prevent criminal aliens from being released back into the community, with little or no additional burden on our local law enforcement partners,” said Marc Rapp, acting Secure Communities executive director.

If any fingerprints match those of someone in the Homeland Security system, the new automated process notifies ICE, which will determine the individual’s immigration status and decide on the appropriate enforcement action after offenders complete their prison terms, the agency said.

Top priority is given to immigrants who pose the greatest threat to public safety, such as those with prior convictions for major drug offenses, murder, rape, robbery and kidnapping.

The Secure Communities biometric identification technology is now accessible to more than 40 state and local law enforcement agencies in Los Angeles County that use electronic booking machines maintained by the Los Angeles County Regional Identification System.

The program has already been implemented in about 78 counties, including Ventura and San Diego, with nationwide coverage expected by the end of 2013, ICE said today.

Secure Communities enhances the ongoing efforts by the Los Angeles County Sheriff’s Department and ICE to identify criminal immigrants in the county’s jail system and process them for deportation, ICE said.

“This is another tool to help identify those arrested for crimes,” Los Angeles County Sheriff Lee Baca said. “It will help keep our streets safer, especially from those serious criminals who keep entering our country illegally.”
