The H-2B visa program is open to citizens of countries that have been designated by the U.S. government as eligible to participate in the program. The steps for applying for an H-2B visa are as follows:
1. U.S. Employer Obtains Labor Certification: The employer must apply for and receive a labor certification from the U.S. Department of Labor (DOL), demonstrating that there are not enough U.S. workers who are able, willing, qualified, and available to perform the temporary services or labor, and that the employment of the foreign worker will not adversely affect the wages and working conditions of similarly employed U.S. workers.
2. U.S. Employer Files a Petition: The U.S. employer must file a petition (Form I-129) with U.S. Citizenship and Immigration Services (USCIS), along with the labor certification, to classify the foreign worker as an H-2B nonimmigrant.
3. Foreign Worker Applies for a Visa: If the petition is approved by USCIS, the foreign worker must apply for an H-2B visa at the U.S. embassy or consulate in their home country. The foreign worker must provide evidence that they meet the requirements for the H-2B visa, such as a valid passport, proof of qualifications for the job, and evidence of ties to their home country that would motivate them to return at the end of their employment.
4. Consular Processing: The U.S. embassy or consulate will review the foreign worker’s application and may schedule an interview. If the visa is granted, the foreign worker can then enter the U.S. to start work on the date specified in the approved petition.
An individual who is already in the United States cannot apply for an H-2B visa. The H-2B visa is for foreign workers who are outside of the United States and are seeking to enter the U.S. temporarily to perform non-agricultural work. If a foreign worker is already in the U.S., they may be able to change their immigration status to H-2B if they meet certain eligibility requirements and their employer files a petition on their behalf..
A foreign worker can stay in H-2B status for a maximum of three years. The length of time that the H-2B visa is valid for depends on the specific needs of the U.S. employer and the foreign worker. An H-2B visa is typically valid for up to one year, but can be extended for up to two additional years, for a total of three years. After the three-year period, the foreign worker must remain outside the U.S. for at least three months before being eligible to return on another H-2B visa. It is important to note that H-2B status is tied to a specific employer and job, and if the job ends before the three-year period, the foreign worker must depart the U.S. immediately.
