If Immigration and Customs Enforcement (ICE) agents come to your door, it’s important for immigrants to understand their rights and how to respond. Here are practical steps to take:
1. Stay Calm and Do Not Open the Door
• You are not required to open the door unless ICE agents present a valid warrant signed by a judge.
• Ask for the warrant to be slid under the door or shown through a window.
2. Verify the Warrant
A valid warrant must:
• Be issued by a judge (not an ICE officer).
• Have your correct name and address.
• If the warrant is not valid, you are not required to let ICE agents in.
3. Do Not Speak Without Legal Representation
Other than verifying your name, you have the right to remain silent. Say:
• “I am exercising my right to remain silent.”
• “I want to speak with an attorney.”
• Do not lie or present false documents, as this could harm your case.
4. Document the Encounter
• Take notes, photos, or videos if it is safe to do so. Record:
• Names and badge numbers of the agents.
• What they say or do.
5. Do Not Sign Anything
• Do not sign any documents without consulting an attorney. These could include forms agreeing to voluntary deportation.
6. Know Who Lives With You
ICE may try to question others in the home. Advise everyone:
• Not to open the door.
• To remain silent and not provide information.
7. Seek Legal Support Immediately
• Contact an immigration attorney or a local legal aid organization for help.
• Have the contact information for a lawyer or immigration advocate readily available.
8. Prepare in Advance
Know Your Rights:
• Everyone in the U.S., regardless of immigration status, has constitutional rights.
Create an Emergency Plan:
• Arrange for someone to care for your children or property if detained.
• Keep important documents (e.g., ID, immigration records) in a safe place.
Key Phrases to Use
• “Do you have a warrant signed by a judge?”
• “I do not consent to you entering my home.”
• “I am exercising my right to remain silent.”
• “I want to speak with a lawyer.”
