El mes pasado, el Noveno Circuito de la Corte de Apelaciones decidió que la Proposición 8 de California – la cual niega el derecho al matrimonio entre parejas del mismo sexo es inconstitucional. El próximo paso en nuestra lucha por la equidad podría ser ante la Suprema Corte de los Estados Unidos (SCOTUS por sus siglas en inglés).
Sí, resulta intimidante pensar que nuestras vidas podrían ser decididas por un grupo de 9 hombres y mujeres en Washington DC Sin embargo, si la mayoría de Jueces escoge la lógica sobre el dogma, será una decisión hostórica que tendrá tremendo impacto sobre nuestras vidas.
Siendo el eterno optimista que soy, creo que si este caso llega ante la SCOTUS, permanecerá la lógica y alcanzaremos la equidad. Mientras tanto, estamos experimentando algunos efectos positivos en el frente de inmigración para las parejas bi-nacionales del mismo sexo.
Bajo algunas circunstancias, los casos de deportación se están cerrando, debido al matrimonio del extranjero con un ciudadano de los Estados Unidos. O algunos casos están teniendo una continuidad mientras se define la Ley de Defensa del Matrimonio (DOMA por sus siglas en inglés). Y en otros casos, las solicitudes de asilo están siendo reconsideradas debido en parte a los matrimonios (del mismo sexo) con ciudadanos de los EE.UU.
Claramente, cada caso es diferente y tiene su propio mérito. El punto es que nuestras relaciones ya no son algo exótico, los Jueces y Oficiales de Inmigración se están volviendo cada vez más familiarizados con la realidad de nuestra existencia.
En otras noticias de inmigración, los candidatos a la presidencia por el partido Republicano continúan criticándose uno al otro por lo irresponsable que serían sobre asuntos de inmigración. La idea de Mitt Romney de arreglar nuestro problema de inmigración se ha transformado a “¡deportación voluntaria!” basicamente pidiéndole a las personas indocumentadas que dejen el país.
Rick Santorum, se opone rotundamente a una amnistía para inmigrantes indocumentados, y cree que construir más cercas en la frontera es parte importante para el control de la inmigración, y también apoya hacer del Inglés la lengua nacional oficial.
Santorum votó en contra de establecer un Programa de Trabajadores Invitados con camino a la ciudadanía, para inmigrantes indocumentados en el 2006. Y también se opone rotundamente a que se les brinde educación a los inmigrantes indocumentados.
Las ideas de Newt Gingrich casi se pueden asociar con la esclavitud legal: Permisos de trabajo para inmigrantes ilegales, llamados “tarjetas rojas (red cards),” a quienes se les permitiría vivir en el país, pero no podrían votar y no tendrían forma de obtener la ciudadanía. Sin embargo, pagarían impuestos y con toda seguridad impuestos al Seguro Social, aunque no serían elegibles para obtener beneficios del Seguro Social.

Immigration News and Politics
Last month, the 9th Circuit Court of Appeals decided that California’s Prop. 8 – which denied the right of marriage to same-sex couples was unconstitutional. Next stop on our quest to full equality might be the Supreme Court of the United States (SCOTUS).
Yes, it is scary that our lives may be decided by a group of 9 men and women in Washington DC. However, if the majority of Justices choose logic over dogma, it will be a historic decision having a tremendous impact on all our lives.
Being the eternal optimist that I am, I believe that should this case make it to the SCOTUS, logic will prevail and we shall achieve equality. In the meantime, we are already experiencing some positive effects on the immigration front for married same-sex bi-national couples.
In some instances, removal or deportation cases are being closed out, due to the marriage of the foreign national to the U.S. citizen. In others, cases are getting a generous continuance pending the outcome of the Defense of Marriage Act (DOMA). Yet in some other cases, asylum requests are being re-considered due in part to a (same-sex) marriage to a US citizen.
Clearly, each case is different and must stand on its own merit. The point being that our relationships are no longer exotic; Immigration Judges and Officers are becoming more and more familiar with the reality of our existence.
In other immigration news, the Republican presidential candidates continued to outdo each other on how irresponsible they would be on the whole issue of immigration. Mitt Romney’s idea of fixing our immigration problem has morphed into “self deportation!” Basically asking undocumented people to just leave the country.
Rick Santorum, strongly opposes amnesty for undocumented immigrants, believes building more fencing along the border is an important part of the immigration issue, and also supports making English the official national language.
Santorum voted against establishing a Guest Worker Program with a path to citizenship for undocumented immigrants in 2006, and is also strongly against in-state tuition for undocumented immigrants.
Newt Gingrich’s ideas borderline on legal slavery: Work permits for illegal immigrants, called “red cards,” who would be permitted to live in the country, but couldn’t vote and would not be on a path to citizenship. However, they would pay taxes and most likely Social Security taxes, though they wouldn’t be eligible for Social Security benefits.
