Reforma de Inmigración Integral

Mientras redacto este artículo, una legislación para una Reforma de Inmigración Integral (CIR por sus siglas en inglés) se ha sometido al Comité Judicial del Senado. Cientos de enmiendas fueron hechas en los primeros dos días y los Senadores están ocupados agregando más. El Senador Patrick Leahy quien encabeza el comité ha indicado que espera que la legislación pueda ser presentada en el piso del Senado para votación en junio.

El Vice Presidente Biden ha indicado que podremos ver una versión final para principios de verano. El Presidente obviamente apoya esta reforma y la firmará. Una vez que tengamos una CIR, aproximadamente 12 millones de indocumentados tendrán la oportunidad de legalizarse.

Esta nueva reforma de inmigración proveerá legalización a personas que han estado aquí por al menos desde el 2011 y que no han cometido algún crimen serio. El tiempo aproximado de espera para convertirse en ciudadanos de los EE.UU. será de aproximadamente 15 años. Los aplicantes elegibles podrán trabajar y viajar mientras tanto.

Hay algunas excepciones a este largo período de espera. Por ejemplo, los aplicantes que fueron traidos aquí siendo niños tendrán sus beneficios primero. También las víctimas de crímenes pueden beneficiarse de una legalización temprana.

Una CIR muy probablemente anulará la regla de un-año para asilo. Presumiblemente, todos los aplicantes que calificaron para asilo pero sometieron sus aplicaciones tarde, podrán reabrir sus casos y obtener asilo, si aún califican.

A pesar de las advertencias por parte de Republicanos, el Senador Leahy introdujo su propia enmienda para incluir el espíritu del Acta para Unir Familias Americanas (UAFA por sus siglas en inglés) en la legislación para proteger a las familias binacionales GLBT dentro del contexto de inmigración. Aunque aun falta que el UAFA se mantenga hasta la versión final de la legislación.

Comprehensive Immigration Reform

As of this writing, legislation for Comprehensive Immigration Reform (CIR) has been introduced in the Senate Judiciary Committee. Hundreds of amendments were filed in the first couple of days and Senators are busy adding more. Senator Patrick Leahy who Chairs the committee has indicated that he hopes the legislation can be presented on the floor of the Senate for a vote in June.

Vice President Biden has indicated that we should see a final bill by early summer. The President is obviously supportive of this bill and will sign it. Once we have CIR, approximately 12 million undocumented individuals will have a chance at legalization.

The overall framework of the bill thus far provides for legalization for people who have been here at least since 2011 and have not committed any serious crimes. The approximate wait time to become a U.S. Citizen is about 15 years. Eligible applicants will be able to work and travel in the meantime.

There are some exceptions to this long waiting period. For example, applicants who were brought here as children will get their benefits first. Also victims of crimes may be able to benefit for earlier legalization.

A CIR will hopefully null the one-year asylum rule. Persumably all the applicants who would have qualified for asylum but filed their applications too late, will be able to reopen their cases and get asylum, if they still qualify.

Despite warnings by Republicans, Senator Leahy introduced his own amendment to include the spirit of Uniting American Families Act (UAFA) in the bill to protect the LGBT binational families within the immigration context. Whether UAFA will make it to the final bill however, is anyone’s guess.
