Cambios con la Propuesta de Ley para Unir Familias Americanas y la Verificación Electrónica

U.S. Rep. Jerrold Nadler (D-NY) planea reintroducir la Propuesta de Ley para Unir Familias Americanas (UAFA), de convertirse en ley, esta propuesta podría proveer a las perejas (del mismo sexo) de ciudadanos estadounidenses con la autorización para inmigrar legalmente a este país. Esta propuesta no altera la definición de matrimonio, por lo que cuenta con apoyo bi-partidista en el Congreso. El Presidente Obama ha indicado que firmaría dicha propuesta si llega a su escritorio.

Es muy importante que llames a tus representantes y les pidas que apoyen la UAFA. Llama al Consejo en el Capitolio de los EE.UU. al (202) 224-3121 y pídeles que te conecten con tu Representante correspondiente. En el Senado, la Senadora Feinstein va a ser pieza clave en la aprobación de la UAFA. Su oficina en el presente está tratando de determinar si apoyar o no esta medida. Si vives en California, es imperativo que contactes su oficina al (202) 224-3841.

Otro importante desarrollo es que por fallas en el programa de Verificación Electrónica, la Secretaria de Seguridad Nacional, Janet Napolitano ha ordenado revizar este programa. Como puede que sepas, muchos estados han estado usando la verificación electrónica para identificar trabajadores indocumentados. Como gobernadora, la Secretaria Napolitano firmó como ley una propuesta que requiere que todos los empleadores en Arizona usen la verificación electrónica. Sin embargo, ahora se sabe que el sistema tiene muchas fallas, incluyendo, pero no limitándose a lo siguiente:

El sistema rechaza de manera preliminar a trabajadores que deberían ser aprobados, particularmente quienes son residentes permanentes legales. Solamente el 0.1% de trabajadores nacidos en los Estados Unidos recibieron noticias de rechazo falsas entre el 2004 y el 2007. La tasa de trabajadores nacidos en el extrangero y que eran residentes permanentes legales fue del 3%. El resultado es un claro incremento en la discriminación hacia trabajadores nacidos en el extrangero.

Lo más importante, las verificaciones electrónicas no impiden que las personas usen identificaciones fraudulentas para estar autorizados para trabajar. Por lo tanto, el intento del Congreso – para impedir que las personas que no están aquí de manera legal obtengan empleos no se ha materializado.
Es refrescante ver a la Secretaria de Seguridad Nacional cómo de hecho entiende los aspectos de nuestras leyes de inmigración que no están trabajando, y tratar de remediarlos. Ciertamente, sin este entendimiento, como pudimos ver por los pasados 8 años, nunca podría darse una discusión honesta sobre cómo arreglar los muchos problemas que tenemos en esta área de la ley.

Defensores de los inmigrantes a nivel nacional quieren trabajar con la Secretaria Napolitano y el Congreso para crear un plan real que no solamente asegure las fronteras, pero que también ofrezca una solución realista para el compromiso que se tiene con los 12 millones de inmigrantes ilegales que se encuentran en el país.

Latest Updates on Uniting American Families Act and E-Verify

U.S. Rep. Jerrold Nadler (D-NY) plans to reintroduce the Uniting American Families Act (UAFA) on Feb. 13! If enacted into law, this bill would provide same sex partners of U.S. citizens to be able to immigrate to this country. This bill does not alter the definition of marriage so it enjoys bi-partisan support in Congress. President Obama has indicated that he would sign such a bill if it gets to his desk.

Its really important that you call your representatives and ask them to support UAFA. Call the U.S. Capitol Switchboard at (202)224-3121 and ask to be connected to your U.S. Representative. In the Senate, Senator Feinstein is going to be instrumental in the passage of UAFA. Her office is presently attempting to come up with a decision on whether or not to back this measure. If you live in California, it is imperative that you contact her office at (202) 224-3841.

Another important development is that due to flaws in the federal E-Verify program, Secretary of Homeland Security, Janet Napolitano has ordered a review of this program. As you may know, many states have been using E-Verify to identify undocumented workers. As governor, Secretary Napolitano signed into law a bill requiring all employers in Arizona to use E-Verify. However it has now become clear that the system has many flaws, including, but not limited to the following:
The system gives preliminary rejections to workers who should be approved, particularly legal permanent residents. Only 0.1% of U.S.-born workers received false rejection notices between 2004 and 2007. The rate for foreign-born workers who were legal permanent residents was 3%. The result is increased discrimination against foreign-born employees.
More importantly, E-Verify does not keep people from using fraudulent IDs to get work authorization. Therefore the intent of Congress – to prevent people who are not here legally to obtain lawful employment is not really materialized.
It is refreshing to see the Secretary of Homeland Security to actually understand the nuances of our broken immigration laws and be responsive to grievances. Certainly without such an understanding, as we witnessed during the past 8 years, there can never be an honest discussion on how to fix the many problems we have in this area of law.

Immigrant advocates nationwide look forward to working with Secretary Napolitano and Congress to come up with a real plan that not only secures our borders but also offers a realistic and fair solution to the plight of over 12 million out of status immigrants in our country.
