En ocasiones, me siento como un disco rayado. Ni siquiera sé cuantos artículos he escrito para Adelante sobre los “derechos para los inmigrantes del mismo sexo” o cómo se le llama actualmente a esta propuesta de ley, La Propuesta de Ley para Unir Familias Americanas (UAFA).
Hace años, el Rep. J. Nadler (D-NY) sometió la propuesta – llamada Propuesta de Ley para Parejas Permanentes de Inmigrantes (PPIA por sus siglas en inglés). Basicamente pretendía otorgar a las parejas gays bi-nacionales los mismos derechos que tienen las parejas bi-nacionales heterosexuales. Esto fue durante los años oscuros de Bush y ni siquiera necesito mencionar que la propuesta de ley jamás vió la luz del día.
Recuerdo que acudí a DC para apoyar esta propuesta junto con algunos de mis colegas. En aquel tiempo me encontraba sorprendido por lo ignorantes que eran las personas encargadas de aprobar las leyes. Incluso fuí buscando ayuda de la Barra de Abogados del Condado de Los Angeles (LACBA) – Sección de Inmigración – pensando que iba a ser todo un triunfo! Luego de que mi resolución en apoyo a PPIA fracasó, se me acercó calladamente un abogado de inmigración de Los Angeles quien debe permanecer en el anonimato, y quien literalmente me susurró en el oido que la próxima vez mejor fuera con el Comité Ejecutivo LACBA, y que debía evitar usar la palabra “gay”, a lo cual respondí tan molesto como pude – “bueno, Señor X, cómo quiere que me refiera a hombres que les gusta sentir pitos en sus traseros?” Por supuesto que salí hecho una tormenta de esa reunión.
Bueno, de eso ya hace mucho. Ahora estamos en el 2009, tenemos a Obama como Presidente y una mayoría Demócrata en el Congreso. Pensariamos entonces que para la UAFA será bastante fácil pasar. Nos equivocamos otra vez!
Permíteme explicar. Aunque estamos más cerca que nunca de que se lleve a cabo el proceso legislativo (de hecho, UAFA tuvo una audiencia de comité en junio del 2009). También, el Sen. Patrick Leahy (D-VT) ofreció una medida similar en el Senado. El señor Leahy también ha dicho que la medida debería ser parte de cualquier ley de inmigración que el Congreso considere.
Pero los fanáticos religiosos se han inmiscuido nuevamente. En una carta al Rep. Michael Honda (D-CA) el Arsobispo John C. Wester de Salt Lake City, el líder del Comité de Obispos Católicos sobre Inmigración, escribió que la Propuesta de Ley para Unir a Familias Americanas podría “corroer la institución del matrimonio y la familia,” al tomar una posición “que es contraria a la naturaleza del matrimonio de acuerdo con la iglesia y el estado.”
Este lenguaje bruto viniendo de un miembro ignorante de la comunidad y el clero, se da porque como nación, nuestros líderes están aun debatiendo la razón de nuestra existencia como comunidad. Cuando el Presidente Obama timidamente admite en cámara que a él todavía le cuesta trabajo aceptar la homosexualidad como una “norma” y le resulta conflictivo el “concepto”, bueno, entonces no me extraña que el Obispo Wester envíe esa carta estúpida y sin sentido a los miembros del Congreso.
Quienes apoyan la PPIA/UAFA siempre han expresado que todos los países de la parte Oeste de Europa, aparte de Canadá, Australia, Nueva Zelanda, Africa del Sur, e Israel ofrecen algún tipo de beneficios de inmigración a las parejas bi-nacionales del mismo sexo. La semana pasada, lei con asombro que ahora Albania, el país más pobre en Europa y que también es un país musulmán – está debatiendo el matrimonio gay en su parlamento. Wow! hasta el mes pasado, estaba teniendo éxito obteniendo asilo político para gays con ciudadanía albanesa, debido a amenazas de persecución por parte de su gobierno y/o su sociedad. Ahora hasta Albania va adelante de nosotros en este debate!
Uniting American Families Act (UAFA)
At times, I feel like a broken record. I don’t even know how many articles I’ve written for Adelante pertaining to “same-sex immigration rights” or as the bill is called these days, Uniting American Families Act (UAFA).
Years ago, Rep. J. Nadler (D-NY) introduced a bill – called Permanent Partners Immigration Act (PPIA). It basically attempted to provide gay bi-national couples the same rights as straight bi-national couples had. This was during the dark Bush years and needless to say that the bill never saw the light of day.
I remember lobbying in support of this bill in DC along with some of my colleagues. Back then I was always amazed at how ignorant our law makers were. I even went to get support of the Los Angeles County Bar Association (LACBA) – Immigration Section – thinking that it would be a slam dunk! After my resolution in support of PPIA was voted down, I was approached very quietly by a well respected LA immigration lawyer who shall remain anonymous, who literally whispered in my ear that next time I go before the LACBA Executive Committee, I should refrain from using the word “gay” to which I responded as bitchy as I could – “ well, Mr. X, how would you like me to refer to men who like to get dicks up their asses?” Needless to say that I stormed out of that meeting.
Well, that was a long time ago. It’s now 2009, we have Obama as President and a Democratic majority in Congress. So one would think the passage of UAFA would be a slam dunk. Wrong again!
Let me explain. Though we are further down the legislative process than we’ve ever been (UAFA actually had a committee hearing in June 2009). Also, Sen. Patrick Leahy (D-VT) has offered a similar bill in the Senate. Mr. Leahy has also said the bill should be part of any broad immigration legislation that Congress considers.
But the religious fanatics are at it again. In a letter to Rep. Michael Honda (D-CA) Bishop John C. Wester of Salt Lake City, the chairman of the Catholic bishops’ Committee on Migration, wrote that the Uniting American Families Act would “erode the institution of marriage and family,” by taking a position “that is contrary to the very nature of marriage which pre-dates the Church and the State.”
All of this hurtful language coming from the ignorant members of community and the clergy at large come because as a nation, our leaders still are debating out loud the very reason for our existence as a community. When President Obama sheepishly admits on camera that he is still having a hard time accepting homosexuality as a “norm” and is conflicted about the “concept”, well, no wonder Bishop Wester sends such stupid filled with utter nonsense to members of Congress.
Supporters of PPIA/UAFA have always stressed that all the countries of Western Europe, in addition to Canada, Australia, New Zealand, South Africa, and Israel offer some type of same-sex immigration benefits to their bi-national couples. Last week, I read with amazement that now Albania, the poorest country in Europe and also a Muslim country – is debating gay marriage in its parliament. Wow! Up until last month, I was successful in obtaining political asylum for gay nationals of Albania due to threats of persecution from their government and/or their society. Now even Albania is ahead in this debate than we are!
