THE HUMAN COST OF TITLE 42

What is Title 42?

Title 42 is part of the Public Health Service Act of 1944. This was aimed to prevent the spread of communicable diseases in the country. Per the law, whenever it is determined that there is a communicable disease in another country, health officials have the authority to stop “the introduction of persons and property from such countries or places”.

Title 42 was activated under the Trump administration and continued under Biden. This was put in place to slow down the spread of COVID-19. Nearly 2 million migrants have been expelled to Mexico, even those legally attempting to seek asylum.

For the past two years, the federal government has used Title 42 as an excuse to turn away migrants at the U.S.-Mexico Border.

No Longer Necessary
The CDC Director has considered the tools available to fight COVID-19 and determined that the vaccines and therapeutics available are highly effective. The Director also determined that it is no longer necessary to maintain the Order suspending the entry of migrants into the United States. The CDC is willing to guide DHS to design a plan to introduce migrants safely into the country by implementing additional COVID-19 mitigation procedures.
Human Cost

Since the CDC announced the end of the policy, there have been various legal and legislative challenges to keep it in place. With midterm elections, there is pressure on both sides of the political aisle to keep Title 42. Judge Summerhays blocked the end of Title 42 and kept it in place giving the Biden administration a stopgap. If there is a flux of immigration, this would give Republicans a new talking point. However, as the policy remains in place, immigration activists are frustrated with the inhumane policy that is keeping migrants in limbo at the Mexico border. Once again, the Biden administration is failing to keep its promises regarding immigration, including ending Title 42. The policy is not being used as a public health measure, but as border protection to control the flux of immigration from the Southern border.

The human cost of enforcing this policy is paid by migrants waiting at the border. Under Title 42, migrants seeking entry have been forced into dangerous parts of Mexico. Since President Biden has taken office, nearly 10,000 cases of kidnapping, torture, rape, and other crimes against migrants impacted by Title 42.

Title 42 has also increased the number of unaccompanied minors and family separation. Many families have been sending their children alone, as they are exempt from Title 42 expulsion. Children traveling alone are more suspectable to dangerous conditions. The “Remain in Mexico Program” also contributes to the dangers that migrants are facing. This requires migrants to wait for a U.S. Immigration Court hearing in Mexico. These border towns can be unsafe. Migrants are specifically targeted because they have all their possessions on their person, and even after they report crimes, Mexico law enforcement does not conduct any investigation.

Cartels in Mexico have been thriving off those who have been expelled or forced to stay in Mexico. Cartels have been monitoring ports of entry and demanding ransom money from families in the U.S. or in their country of origin.

The Impact of Lifting Title 42
Under Title 42, the U.S. is leaving thousands of immigrants in vulnerable positions across the border, and they are more susceptible to COVID-19 outbreaks. The purpose of Title 42 is to reduce the transition of diseases. Keeping migrants crowded in border towns, or returning to their origin country, does little to protect them against the pandemic. The CDC has advocated ending the use of Title 42 because it lacks a public health justification for expelling migrants. Title 42 is unjustifiable as other pandemic-related border restrictions have been eased back.

Many argue that ending Title 42 could cause a large influx of immigration and overwhelm border agents. There is sufficient data regarding immigration patterns to inform border agents of peak periods. In addition, the “Remain in Mexico” policy means that migrants are trying repeatedly to get across the border and giving inflated numbers of “encounters”.

Conclusion
The U.S. has a responsibility as a global power to respect international law and accept refugees. The U.S. asks other nations to take in refugees yet refuses to do the same. President Biden’s administration needs to take a stance in favor of immigrants and demonstrate that his campaign promises were not just empty words. Despite misleading numbers, immigration is at its lowest with a decline in recent years. By keeping Title 42, Biden is enhancing xenophobic rhetoric that immigrants come with “diseases” and that there is an “invasion” on the way. President Biden needs to do the right thing by ending Title 42 and allowing migrants to exercise their legal right to seek asylum.

¿Qué es el Título 42?

El Título 42 es parte de la Ley del Servicio de Salud Pública de 1944. Este tenía como objetivo prevenir la propagación de enfermedades transmisibles en el país. Según la ley, siempre que se determine que existe una enfermedad contagiosa en otro país, los funcionarios de salud tienen la autoridad para detener “la introducción de personas y bienes de dichos países o lugares”.

El Título 42 se activó bajo la administración Trump y continuó bajo Biden. Esto se implementó para frenar la propagación de COVID-19. Casi 2 millones de migrantes han sido expulsados a México, incluso aquellos que intentan solicitar asilo legalmente.

Durante los últimos dos años, el gobierno federal ha utilizado el Título 42 como excusa para rechazar a los inmigrantes en la frontera entre Estados Unidos y México.

Ya no es necesario

El director de los CDC ha considerado las herramientas disponibles para combatir el COVID-19 y ha determinado que las vacunas y las terapias disponibles son altamente efectivas. El CDC está dispuesto a guiar al DHS para diseñar un plan para introducir a los migrantes de manera segura al país mediante la implementación de procedimientos adicionales de mitigación de COVID-19.

Costo humano

El Impacto de parar el Título 42

Conclusión

La administración del presidente Biden necesita tomar una postura a favor de los inmigrantes y demostrar que sus promesas de campaña no fueron solo palabras vacías. A pesar de las cifras engañosas, la inmigración está en su punto más bajo con una disminución en los últimos años. Al mantener el Título 42, Biden está potenciando la retórica xenófoba de que los inmigrantes vienen con “enfermedades” y que hay una “invasión” en camino. El presidente Biden debe hacer lo correcto al poner fin al Título 42 y permitir que los migrantes ejerzan su derecho legal de solicitar asilo.
