Nueva Ley Hace Elegibles a Indocumentados para Licencias de Conducir.

En Octubre, el Gobernador Jerry Brown firmó la nueva ley “AB60.” La AB60 terminó con una lucha de 15 años de legisladores latinos para darle permisos de conducir en California a inmigrantes indocumentados. Especificamente, la Ley de la Asamblea 60 (AB60) requiere que el DMV otorgue licencias de conducir a aplicantes que no puedan presentar prueba de que su presencia en los Estados Unidos está autorizada por la ley federal. Para calificar, el aplicante debe cumplir con todos los requisitos para obtener una licencia de conducir en California – exámenes escrito y de manejo por el DMV.
El borrador original de la AB60 provehía licencias a cualquier persona que pudiera probar que trabajaba o pagaba impuestos en los Estados Unidos. La ley final, sin embargo, le deja al DMV determinar los documentos requeridos. Cuando la concesión entre en efecto, que se espera sea para el primero de enero de 2015, o antes, será la primera vez que inmigrantes indocumentados tengan la oportunidad de conducir de manera legal en California. Esta es una noticia emocionante para casi todas las personas indocumentadas en California. De hecho, el DMV estima que aproximandamente 1.4 millones de personas obtendrán la licencia como producto de esta ley.
De este modo, las personas que obtengan su licencia no se verán forzadas a tomar transporte público o pasar por los riesgos de conducir de manera ilegal. Poniéndolo un poco diferente, cuando se comiencen a otorgar las licencias, las personas que califiquen podrán conducir de manera legal a sus trabajos, llevar a sus hijos a las escuelas, conducir al hospital, etc. La AB60 por lo tanto, proveerá a las personas con la libertad y protección con que cuentan otros trabajadores en el estado.
Además, cuando la medida especial se ve en conjunto con la reciente postura que la Cámara de Representantes de los Estados Unidos parece haber tomado contra la Ley de Inmigración que el Senado aprobó hace aproximadamente un año, queda claro que estas licencias podrían ser lo más cercano a una forma de identificación en los Estados Unidos para muchos inmigrantes indocumentados a futuro próximo.
La ley no solamente proveerá a los inmigrantes indocumentados que califiquen con una forma de identificación oficial en los Estados Unidos, junto con la libertad y protección que merecen, sino que también, como argumentan los impulsores de la medida, esto hará que las carreteras sean más seguras para todos en el estado. Los conductores que sean aprobados tendrán también que obtener un seguro de auto, y tendrán un entrenamiento que incluirá exámenes por escrito y de manejo, requeridos por el DMV. Y ya que muchos inmigrantes indocumentados están ya conduciendo de manera ilegal, esta ley se asegurará de que todos aprendan las reglas del camino, pasen un exámen de manejo y obtengan un seguro de auto.
Luego de la audiencia pública, el departamento dará a conocer sus recomendaciones finales a la Oficina de Ley Administrativa para que la revice, lo que requiere que el DMV comience a otorgar licencias a aplicantes indocumentados que califiquen para la ley que entra en práctica el primero de enero de 2015.
Ten en mente sin embargo que esas licencias especiales no otorgan eligibilidad para trabajar, votar, u obtener beneficios públicos.Las licencias no tienen beneficio alguno bajo las leyes de inmigración de los Estados Unidos. New Law Makes Undocumented Aliens Eligible for Driver’s License.

In October, Governor Jerry Brown signed Assembly Bill 60 “AB60.”AB60 ended the 15year fight by Latino lawmakers to give undocumented immigrants currently residing in California permission to drive. Specifically, Assembly Bill 60 requires the DMV to issue a driver’s license to applicants who cannot submit proof that their presence in the United States is authorized by federal law. To qualify, the applicant must meet all other qualifications for a driver license in California – written and driving tests by the DMV.
The original draft of AB60 provided licenses to anyone who could prove they work or pay taxes in the United States. The final Bill, however, leaves it up to the DMV to determine the required documents. To view the documents that the DMV requires for issuance of the special driver’s license, you can look it up on the official California DMV website.
When the grant comes into effect, which it is expected to January 01, 2015 or earlier, it will be the first time undocumented immigrants have the opportunity drive legally in California. This is exciting news for almost all undocumented individuals in California. In fact, the DMV estimates that about 1.4 million individuals will become licensed with the enactment of the Bill.
As such, the individuals who do become licensed will no longer be forced to take public transportation or risk the dangers of driving illegally. Put differently, when the grant is implemented, the qualified individuals will be able to legally drive to work, legally drive their kids to school, legally drive to the hospital etc. AB60, therefore, will provide the qualified individuals with the freedoms and protections which other working and law abiding individuals in the state currently enjoy.
Moreover, when the special grant is viewed in conjunction with the recent stance the U.S. House of Representatives seems to have taken against the Immigration Bill the Senate passed about a year ago, it becomes strikingly clear that the grant may be the closest many undocumented immigrants will get to an official American identity in the near future.
The Bill will not only provide undocumented qualified immigrants with an official American identity along with the simple freedoms and protections they deserve but also, as proponents of the Bill argue, the grant will make the roads safer for everyone in the state. Approved drivers,that is, become eligible for, and must obtain, insurance and training, including written and driving tests required by the DMV. And because many undocumented immigrants are already driving illegally, this Bill will ensure that everyone learns the rules of the road, passes a driver’s test and gets insured.
After the public hearing, the department will deliver its final recommendations to the Office of Administrative Law for review, which requires the DMV to begin issuing licenses to undocumented applicants who qualify under the Bill by January 01, 2015.
Keep in mind, however, that the special licenses do not establish eligibility for employment, voting or public benefits. Further, the licenses are not considered a benefit under U.S. Immigration law.
