Algunas sugerencias para el Congreso para arreglar las leyes de inmigración.
Mientras entramos en un nuevo año – aun tenemos aproximadamente 12 millones de inmigrantes indocumentados en los Estados Unidos. Esto como resultado directo de malas leyes de inmigración aprobadas por los miembros del Congreso, quienes con frecuencia no tienen una completa apreciación de los efectos de sus legislaciones de remedio temporal.
Lo que significa 12 millones de indocumentados:
- Menos seguridad. No podemos tener un registro de todas las personas que viven en este país.
- Menor GDP (por sus siglas en inglés). Imaginen si injectamos la economía con un estímulo como resultado de legalizar a tanta gente, y proveerles con las herramientas para apropiadamente integrarse al comercio de este país.
- Mayores gastos para el gobierno federal. Cada deportación le cuesta al gobierno miles de dólares. Al destinar nuestros recursos financieros en remover a extranjeros criminales en lugar de usar un criterio de “una talla para todos” – seremos más eficientes en la implementación de nuestras leyes.
- Una destrucción sistemática de familias. El Presidente Obama es ahora el enforzador más feroz de los estatutos de deportación en nuestra historia. No hay sociedad que pueda florecer con semejante record. Este parámetro debe parar.
Como abogado de inmigración desde 1996 – me gustaría dar algunas sugerencias a nuestros representantes electos sobre cómo resolver muchos de estos problemas – sin la necesidad de aprobar la tan elusiva reforma de inmigración.
- Expander el programa de Libertad Condicional.
– En el presente, las familias de militares gozan de este privilegio. Simplemente, si un extranjero es elegible para obtener su tarjeta verde pero por su entrada no autorizada a los Estados Unidos, DHS le otorgarán documentos de entrada tardía (libertad condicional) para que puedan pagar las multas aplicables y obtener su legalización sin tener que ser separados de sus familias.
- Restaurar las resoluciones a discreción de los jueces de inmigración.
– Los jueces de inmigración hacían mayores decisiones a discreción, sobre las personas que acudían a ellos. Esto permitía audiencias con un mayor balance, lo cual es fundamental en la tradición estadounidense. Démosle a nuestros jueces la flexibilidad que necesitan para tomar decisiones más justas.
- Restablecer la sección 245(i) de la Ley de Inmigración y Nacionalidad.
– Antes del 30 de abril de 2001 – las personas que eran elegibles para recibir su tarjeta verde pero habían entrado al país sin autorización, tenían que pagar una multa de $1,000.00 antes de proceder. El Congreso eliminó esta posibilidad. Como consecuencia, tenemos a millones de personas que están dispuestas y tienen la capacidad de pagar esta multa pero no se les permite. Una eliminación de entrada de dinero que el Congreso autorizó. Inconcebible!
El tamaño de la población indocumentada se vería drasticamente reducida si cualquiera de esas medidas (o todas) que he sugerido se implementaran. Es el acercamiento fiscal y moral apropiado, ya que el gobierno tendría mayores ingresos, el costo de enforzamiento se vería reducido, y el país estaría más seguro. Estos son logros de los que todo congresista puede presumir al llegar las elecciones de noviembre. Demandemos acción de nuestros líderes del congreso este año. Some suggestions for Congress on fixing our immigration laws.
As we embark on a new year – we still have about 12 Million undocumented immigrants in the U.S. This is a direct result of a set of bad immigration laws passed by members of Congress who often do not have a full appreciation of the effects of their band-aid style legislation.
12 Million undocumented individuals means the following:
- Less security. We don’t have a full account of everyone who is living in our country.
- Smaller GDP. Imagine if we inject our economy with a stimulus resulting from bringing this many people into the fold and providing them with the tools to properly engage in commerce.
- Higher spending for the federal government. Every deportation costs the government tens of thousands of dollars. By focusing our precious financial resources to removing criminal aliens instead of a one size fits all approach – we’ll be more efficient and effective in the implementation of our laws.
- A systematic destruction of families. President Obama is now the most ferocious enforcer of removal statues in our history. No society may flourish with such a record. This pattern must stop.
As an immigration attorney in the trenches since 1996 – I’d like to offer some suggestions to our elected representatives on how to solve many of these problems – without the need to reach the ever so elusive comprehensive immigration reform deal.
- Expand the Parole in Place program.
– Presently, military families enjoy this privilege. Simply, if a foreign national is eligible to get a green card but for his/her unauthorized entry in the US, DHS will issue them belated entry (parole) documents so they may pay the filing fees and get their status sorted without having to be separated from their families.
- Restore the discretion of immigration judges.
– Immigration judges used to have far more discretion in deciding the fate of individuals who appeared before them. This allowed for a fair and balanced court hearing which is a fundamental American tradition. Let’s give our judges the flexibility they need to reach more equitable decisions
- Reinstate section 245(i) of the Immigration and Nationality Act.
-Prior to April 30, 2001 – persons who were eligible to receive their green cards but had entered the country without authorization, had to pay a fine of $1,000.00 before they could proceed. Congress allowed this law to sunset. Consequently we have millions of people who are willing and able to pay this fine but are unable to do so. A source of revenue cut by the hands of our Congress. Unconscionable!
The size of the undocumented population will drastically be reduced if any or all these suggestions are implemented. It’s the fiscally and morally right approach since the government will have more revenue, the costs of enforcement will be trimmed and the country will be more secure. These are achievements that every member of congress can rightfully boast about come election time in November. Let’s demand action from our congressional leaders this year.
