Acción Ejecutiva en materia de inmigración
A pesar de las llamadas de un sin número de grupos alrededor del país para lograr una Reforma de Inmigración Integral (CIR por sus siglas en inglés), la Cámara de Representantes de los EE.UU. suspendió sesiones en agosto para el verano, sin lograr una legislación realista en relación con inmigración. Como resultado de este fallo épico del Congreso, el Presidente ha decidido usar su autoridad para limpiar parte del caos creado por nuestras fallidas leyes de inmigración. Grupos defensores de los inmigrantes esperan que se de una serie de órdenes ejecutivas amplias y significativas por parte del Presidente Obama.
Mi mejor y único consejo para cualquiera que quiera tomar ventaja de las decisiones del Presidente, cualquiera que estas sean, es consultar con un abogado de inmigración – NO con un consultor legal o notario. Aparte de tener el conocimiento y la experiencia para resolver problemas complejos, los abogados de inmigración están regulados por un Colegio de Abogados. Los consultores de inmigración no están regulados por nadie. Por lo tanto, si surge algún asunto con tu caso, como comunmente pasa, y no es manejado apropiadamente por un “consultor” de inmigración no existe ningún recurso a tu favor. Sin embargo, si un abogado maneja inapropiadamente tu caso, existe responsabilidad y probablemente un camino a seguir para corregir el error.
Desafortunadamente, lo que sea que se proponga el Presidente será limitado en el mejor de los casos, ya que es responsabilidad del Congreso promulgar las leyes. Por lo tanto, la urgencia de reformar nuestras leyes de inmigración para que reflejen de manera más apegada a la realidad del Siglo XXI permanece intacta. Los lemas de campaña que tienen que ver con seguridad en la frontera, la auto-deportación, y procesamiento en masa de migrantes indocumentados no solamente son un insulto a nuestra inteligencia, sino que también dañan nuestra identidad nacional y nuestra seguridad. No debemos permitir que grupos minoritarios de distritos republicanos bloqueen el progreso de nuestra nación.
Con las elecciones de medio término en noviembre, es imperativo que nos hagamos oír. Llama/escribe/visita a tus representantes en el Congreso y pídeles su apoyo a una reforma de inmigración. Executive Action on Immigration
Despite calls from a variety of constituencies around the country for comprehensive immigration reform (CIR), U.S. House of Representatives adjourned for the summer last August without any realistic immigration legislation. In light of this epic Congressional failure, the President has decided to use his authority to clean up some of the mess created by our broken immigration laws. Immigrant advocacy groups hope for a series of broad and meaningful Executive Orders from President Obama.
My best and only advice for anyone wanting to take advantage of the President’s directives, whatever they may be, is to consult with an immigration attorney – NOT with an immigration CONSULTANT/NOTARIO. Aside from having the knowledge and the expertise to be able to solve complex problems, immigration attorneys are regulated by a Bar Association. Immigration consultants are not regulated by anyone. Therefore if an immigration matter, as is usually the case, is mishandled by an immigration “consultant” – there is no recourse! However, if an attorney mishandles your case, there is liability and probably a way forward to fix the mistake.
Unfortunately, whatever the President proposes will be limited at best, because it is Congress’ duty to be making laws. Therefore, the urgency to reform our immigration laws so they more accurately reflect the realities of the 21st Century remains in place. The campaign slogans having to do with border security, self-deportation, and en-mass prosecution of undocumented migrants are not only an insult to our intelligence, but also damaging to our national identity and security. We must not allow a vocal GOP minority from gerrymandered districts to block the progress of our nation’s business.
With the midyear elections coming up in November, it is imperative that we make our voices heard. Call/write/visit your Congressional representatives and ask for their support of immigration reform legislation.
