Special Immigrant Juvenile Status is an immigration classification available to certain undocumented immigrants under the age of 21 who have been abused, neglected, or abandoned by one or both parents. SIJS is a way for immigrants under twenty-one to apply for and obtain legal permanent residence in the United States.
U.S. Citizenship and Immigration Services (USCIS) will now offer deferred action and employment authorization under Special Immigrant Juveniles (SIJs) who are ineligible to apply for adjustment of status solely due to visa unavailability.
The SIJS, and the criteria are:
1. The applicant must be under 21 years old;
2. He/she must be unmarried;
3. He/she must be declared dependent in a juvenile court. This means that the Family Court must take jurisdiction over a petition addressing the needs of the applicant;
4. Reunification with one or both of the child’s parents must no longer be a viable option due to abuse, neglect, abandonment or a similar basis under state law; AND
5. It is not in the best interests of the minor to return to his/her country of nationality or last habitual residence.
The steps on getting SIJS is as follows:
1. The minor must obtain a judgement from the Superior Court declaring him/her to be as unaccompanied
2. The minor then has to apply to the United States Citizenship and Immigration Service (USCIS) for SIJS.
Based on the new rule issued by USCIS – applicants with SIJS status may immediately apply for work authorization and remain in the U.S. until such time that their visa numbers are ready to apply for a green card.

El estatus de inmigrante juvenil especial es una clasificación de inmigración disponible para ciertos inmigrantes indocumentados menores de 21 años que han sido abusados, descuidados o abandonados por uno o ambos padres. (SIJS) es una forma para que los inmigrantes menores de veintiún años soliciten y obtengan la residencia permanente legal en los Estados Unidos.
Los Servicios de Ciudadanía e Inmigración de EE. UU. (USCIS) ahora ofrecerán acción diferida y autorización de empleo bajo Inmigrantes Juveniles Especiales (SIJs) que no son elegibles para solicitar el ajuste de estatus únicamente debido a la falta de disponibilidad de visa.
El Estatus Especial de Inmigrante Juvenil (SIJS), y los criterios son:
1. El solicitante debe ser menor de 21 años;
2. Él / ella debe ser soltero;
3. Debe ser declarado dependiente en un tribunal de menores. Esto significa que el Tribunal de Familia debe tener jurisdicción sobre una petición que aborde las necesidades del solicitante;
4. La reunificación con uno o ambos padres del niño ya no debe ser una opción viable debido a abuso, negligencia, abandono o una base similar según la ley estatal; Y
5. No es del interés superior del menor regresar a su país de nacionalidad o última residencia habitual.
Los pasos para obtener Estatus Especial de Inmigrante Juvenil (SIJS) son los siguientes:
1. El menor debe obtener una sentencia del Tribunal Superior que lo declare como no acompañado
2. Luego, el menor debe solicitar SIJS al Servicio de Ciudadanía e Inmigración de los Estados Unidos (USCIS).
Según la nueva regla emitida por USCIS, los solicitantes con estado SIJS pueden solicitar inmediatamente una autorización de trabajo y permanecer en los EE. UU. hasta el momento en que sus números de visa estén listos para solicitar una tarjeta verde.
